    a state of order in which events conform to the law
    Principles that society applies to all
    Everyone must follow the law
  8. unambiguous
    having or exhibiting a single clearly defined meaning
    not clear, doubtful or uncertain nature; difficult to comprehend, distinguish, or classify
  9. boisterous
    marked by exuberance and high spirits
    (of a person, event, or behavior) Noisy, energetic, and cheerful; rowdy.
  10. substantive
    having a firm basis in reality and therefore important
    the part of the law that defines crimes and specifies punishments
  11. civil law
    the legal code of ancient Rome
    law between parties
    Punishment – fines (compensation)
  12. tort
    a wrongdoing for which an action for damages may be brought
    breach of contract
  13. administrative law
    the body of rules and regulations and orders and decisions created by administrative agencies of government
    controls activities of businesses
    *Can become a crime if harms individuals (toxic waste)
    Example(s): tax laws, OSHA, Building codes, EPA, FDA, EEOC, ISO

    an example that is used to justify similar occurrences

  15. procedural
    of or relating to processes
    Body of rules that enforces legal rights
    Examples: reading individuals Miranda
  16. felonious
    involving or being or having the nature of a crime
    felonies- serious crime(s)
    Punishment: death or incarceration
    Examples: murder, rape, aggravated assault, robbery, burglary, etc.
  17. misdemeanor
    a crime less serious than a felony
    minor crime(s)
    Punishment: Fine, community services
    Examples: petty theft, stealing items of little worth, simple assault, being disorderly in public, disturbing the peace
  18. offense
    a failure to show regard for others
    violation of law
    Offense Crimes – less than a misdemeanor
  19. infraction
    a violation of a law or rule
    ticketed and release, must appear in court for hearing / fine(s)
  20. treason
    a crime that undermines the offender's government
    someone who tries to overthrow the government of which they are a member of
  21. espionage
    the systematic use of spies to obtain secrets
    someone who gathers, transmits, or purposely looses information related to the US and becomes available to enemies to use against the US to their advantage
  22. inchoate
    only partly in existence; imperfectly formed
    Inchoate Offense Incomplete - Incomplete or partially done
  23. mens rea
    criminal intent
    "Culpable Mental Stat" - a guilty mind (existing only in the mind)
    Four levels of mens rea:
    Purposeful / Intentional, knowing, reckless and negligent
  24. criminal negligence
    (law) recklessly acting without reasonable caution and putting another person at risk of injury or death (or failing to do something with the same consequences)
    harm others w/out no intentions
  25. motive
    the reason that arouses action toward a desired goal
    person reason
  26. liability
    the state of being legally obliged and responsible
    strict liability - offender has no intentions of violating the law but with the harm they cause, they are responsible (i.e. those who speed)
  27. concurrence
    the property of two things happening at the same time
    a guilty mind and act to harm an individual
  28. ex post facto
    affecting things past
    cannot hold someone accountable for crimes they committed prior to law going into effect
  29. corpus delicti
    the body of evidence that constitute the offence
    Body of the crime “the corps”
  30. justification
    the act of defending or explaining by reasoning
    to prevent greater harm
    Examples: self defense, defense of others, defense of home and property, necessity, consents, resisting unlawful arrest
  31. excuse
    a defense of some offensive behavior
    A reason or explanation put forward to defend or justify a fault or offense
